In the event of being awarded the contract, we could envisage commissioning an as yet to be established project company with the tasks of energy supply. Is there anything we should observe or furnish evidence of during this pre-qualification phase?

We are a 100% subsidiary of ....... responsible for energy services in the former East German states. As a limited company, we do not however comply with the legal entity (GbR) outlined in item III.1.3.
Is this legal form absolutely necessary for participation in the bidding process?

The legal form detailed in item III.1.3 the information published is of relevance for bidders / consortiums of bidders and for a joint-venture to be formed in the event of the contract being awarded and does not apply for individual bidders.

Inspection of the documentation has given rise to the following question:
Must all documentation required by you be furnished for subcontractors such as ..... as a block-type thermal power station supplier or .............. as a civil engineering and pipeline company as for third parties / subcontractors?
We are planning to present ourselves as a sole contract partner but like everyone else, are obliged to purchase components on the market and have them assembled by assembly companies.
We would appreciate a reply as soon as possible.

In so far as the bidder wishes to rely on resources provided by third parties / subcontractors in order to furnish evidence of economic, financial and technical efficiency, the declarations and evidence outlined in item III.2 of the information published must be submitted.
Furthermore, a declaration on the part of third parties / subcontractors must be submitted indicating their willingness to provide services for the project.
